1. Introduction

These Terms and Conditions (“Terms”) govern your booking and participation in any tours or safari services provided by us Amboseli Plains Safaris Limited. By booking a tour, you agree to be bound by these Terms.

2. Booking Process

  • Reservations: A reservation is considered confirmed upon receipt of a deposit of 20% of the total tour price. The remaining balance is due 60 Days before the tour starts.
  • Payment Methods: We accept payments via credit card, bank transfer, and mobile payments. All fees, including any transaction fees or currency conversion costs, are the responsibility of the client.
  • Late Payments: Failure to pay the remaining balance by the due date may result in the cancellation of your booking, with the deposit forfeited.

3. Cancellation and Refunds

Client Cancellation: All requests to cancel confirmed reservations must be in writing via our email to amboseliplains@gmail.com/info@amboseliplainsafaris.com and Amboseli Plains Safaris Limited must confirm receipt of cancellation in writing. If there is no acknowledgement of the cancellation by Amboseli Plains Safaris Limited, It means your cancellation has not been received and therefore not valid. If you wish to cancel your booking, the following cancellation fees apply:

  • More than 160 days prior to departure: you are subject to administrative fee of $400 per person. The balance of your deposit will be refunded to you.
  • 120 days to 60 days before departure: you are subject to 20% Cancellation fee of the total tour cost.
  • 59 days to 30 days prior to departure: You are subject to 50% cancellation fee of the total tour cost. Less than 29 DAYS before departure: No refund.

Failure to show up for the safari without prior notice of cancellation will result in a complete forfeiture of the booking cost. No refunds will be issued for no-shows.

Once a cancellation is confirmed and approved, refunds will be processed within 30 working days. Refunds will be issued using the same payment method used during booking.

Tour Changes by Us: We reserve the right to cancel or alter your tour in the event of circumstances beyond our control, such as weather conditions or force majeure events. In such cases, we will offer you either a full refund or an alternative tour option.

4. Health and Fitness Requirements

Fitness for Travel: Certain tours may require a certain level of physical fitness. It is your responsibility to ensure you are medically fit for the tour you have booked. If you have any health concerns, please consult with your doctor prior to booking.
Medical Emergencies: In case of a medical emergency, we will assist in arranging necessary care, but we are not liable for medical expenses. We strongly recommend having appropriate travel insurance.

5. Travel Insurance

We recommend that all clients purchase comprehensive travel insurance covering cancellation, medical expenses, personal injury, lost luggage, and other potential travel disruptions. You are responsible for securing your own insurance before departure.

6. Responsibility for Personal Belongings

You are responsible for your own belongings during the tour. Amboseli Plains Safaris Limited is not liable for any lost, stolen, or damaged items while on the tour. Please take care of your valuables and keep them in a secure location.

7. Behavior and Conduct

Code of Conduct: You agree to behave responsibly and respectfully toward fellow passengers, staff, and the local communities you visit. We reserve the right to remove you from the tour if your behavior is disruptive, dangerous, or inappropriate, and no refund will be given in such cases.

Wildlife and Nature: We ask that all participants follow the guidance of our guides when interacting with wildlife or nature to ensure safety for both yourself and the environment.

8. Liability

Limitation of Liability: Amboseli Plains Safaris Limited will not be liable for any injury, death, loss, or damage to personal property during the course of the tour. By participating, you assume all risks associated with the activities.

Third-Party Services: We may engage third-party suppliers for certain activities or services during your tour. Amboseli Plains Safaris Limited is not liable for any issues or accidents caused by third-party suppliers.

9. Force Majeure

We will not be held responsible for any delays, changes, or cancellations caused by situations beyond our control, including but not limited to natural disasters, political unrest, pandemics, or strikes. In such cases, we will notify you as soon as possible and offer alternative arrangements or a refund.

10. Privacy and Data Protection

We are committed to protecting your personal data. Any personal information you provide during the booking process will be used solely for providing and managing your tour. We will not share your personal data with third parties without your consent, except as necessary for fulfilling the tour.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these terms will be subject to the exclusive jurisdiction of Kenyan courts.

12. Acknowledgment of Terms

By booking a tour with Amboseli Plains Safaris Limited, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
